Notice is hereby given that 455 Alexander, LLC and Tierra Investors, LLC, have submitted a Petition for Annexation for property legally described as in the North Half of Section 26 of Township 7 South, Range 67 West of the 6th Principal Meridian, Douglas County Colorado. Located east of the Silver Heights subdivision, north of Alexander Place, and west of the Diamond Ridge Estates subdivision.
All interested parties are invited to participate in the Town Council public hearing on Oct. 19, 2021 at 6 p.m. This is a hybrid meeting offering in-person and virtual attendance options. Public comments are encouraged.

Annexation is a three-step process. During the first two steps, Substantial Compliance and Eligibility, Town Council determines whether an annexation request meets the statutory requirements for annexation established in the Colorado Revised Statutes (C.R.S.), specifically the Municipal Annexation Act of 1965 (Act). The third step is when Town Council determines whether an annexation request complies with the Town’s guiding documents and the Municipal Code, and if the property should be annexed to the Town.
The purpose of the Substantial Compliance Hearing is for Town Council to determine if the annexation petition is in the prescribed form and contains the necessary statutory criteria. For example, in order to be compliant with the statutes, a finding must be made that the petitioners constitute more than 50% of all landowners and that the petitioners own more than 50% of the total area of the property, excluding certain public ownership. Town Council must also set a date, time and place for an Eligibility Hearing.
The subject property consists of approximately 73.76 acres. The property is zoned A-1 – Agricultural One in unincorporated Douglas County.

The first two steps in the annexation process are procedural and subject to the requirements established in the Colorado Constitution and C.R.S. The first two steps, Substantial Compliance and Eligibility determine whether the property can be annexed to the Town. The third step, Annexation and Zoning determines whether a property should be annexed to the Town.
At the upcoming Substantial Compliance Hearing on Oct. 19, 2021, Town Council will consider a resolution finding the Petition for annexation is in the prescribed form and contains the necessary statutory criteria. If Town Council finds the petition to be in the prescribed form and contains the necessary statutory criteria, then Town Council must set a date, time, and place for an Eligibility Hearing. The Eligibility Hearing must occur between 30 and 60 days after the Substantial Compliance Hearing.
Once an annexation petition has been found to be both substantially compliant and eligible for annexation, then the Annexation Petition and Plat, and the request for zoning may proceed to the Annexation and Zoning public hearings before the Planning Commission and Town Council. The dates of the Annexation and Zoning public hearings will be set and publically noticed once the staff review of the proposal is complete and all comments have addressed and resolved.
