You are invited to attend a public hearing to be held before the Castle Rock Town Council for the purpose of determining whether the property known as Crowfoot Valley Road Annexation is eligible to be annexed according to the statutory requirements for annexation as established in the Colorado Revised Statutes, specifically the Municipal Annexation Act of 1965 (Act).
Public comment is encouraged and all interested parties are invited to participate in the Town Council public hearing on October 17, 2023 at 6 pm. The hearing will be in a hybrid format allowing both in-person or virtual attendance.

Proposal description
The Town of Castle Rock, as property owner and applicant, has submitted a Petition for Annexation for four unincorporated parcels in Douglas County, known as Crowfoot Valley Road Annexation. Collectively, the property is approximately 5.31 acres in size and is located within the Crowfoot Valley Road right-of-way (ROW), east of the Crowfoot Valley Road/Tower Road intersection and west of the Crowfoot Valley Road/Macanta Boulevard intersection. The vicinity map and annexation plat are attached.
Annexation would bring the property under Town jurisdiction, which allows for consistent enforcement of the Town Municipal Code and avoids emergency services conflicts or redundancy, regarding which jurisdiction governs the property. The Town is not proposing any change to the permitted ROW use on the property. Annexation process – eligibility
Annexation is a three-step process. In the first two steps, Substantial Compliance and Eligibility, Town Council determines whether an annexation request meets the statutory requirements for annexation as established in the Colorado Revised Statutes, specifically the Municipal Annexation Act of 1965. In the third step, Annexation and Zoning Hearing, Town Council determines whether an annexation request complies with the Town’s guiding documents and the Municipal Code, and if the property should be annexed into the Town.
At the Substantial Compliance Hearing held on September 5, 2023, Town Council approved a resolution finding that the Petition for annexation was in the prescribed form, contained the necessary statutory criteria and set the Eligibility Hearing for October 17, 2023 at 6 pm. This allowed the annexation request to move to the second step in the annexation process.
At the upcoming Eligibility Hearing, Town Council will determine whether the statements made in the Petition (referred to as “allegations” in the statute) are supportable and that the property is eligible to be annexed under the Act.
Once an annexation petition has been found to be both substantially compliant and eligible for annexation, then the Annexation Petition and Plat, and the request for zoning may proceed to the Annexation and Zoning public hearings before the Planning Commission and Town Council. The dates of the Annexation and Zoning public hearings will be publically noticed once the staff review of the proposal is complete and all comments have addressed and resolved.
Public hearing – eligibility
The Town Council agenda can be accessed by clicking “View Current Agenda” at https://crgov.com/2841/Council-Agendas. The agenda for the October 17, 2023 Town Council public hearing will be posted no later than close of business October 12, 2023. When it is time for this item to be heard at the public hearing, staff will give a presentation on the proposed project and summarize compliance with the Eligibility criteria. There will be an opportunity for the public to address Town Council on this proposal after the presentation is complete and Town Council opens the public comment period.
