You are invited to attend a public hearing to be held before Town Council for the purpose of determining whether the annexation petition, submitted by George Mattione, requesting annexation of Ridgeview Town Center is in Substantial Compliance with the applicable requirements of the Colorado Revised Statutes (C.R.S.), in particular the Colorado Municipal Annexation Act of 1965 (Act). The meeting will be hybrid, meaning you may attend either in-person or virtually via Webex, or by phone.

Project description

The property is located at 895 Ridge Road, legally described as situated in the NW ¼ of Section 7, Township 8 S, Range 66 W of the 6th Principal Meridian and in the NE ¼ of Section 12, Township 8 S, Range 67 W of the 6th Principal Meridian, County of Douglas, State of Colorado. The total area is 10.54 acres. The vicinity map and annexation plat are attached.

Substantial compliance

The Substantial Compliance hearing is the first of three Town Council hearings to be held in the process of determining whether a property will be annexed to the Town.  At the Substantial Compliance hearing, Town Council must determine if the annexation petition is in the prescribed form and contains the necessary statutory allegations established in C.R.S. §31-12-107(1) and §31-12-108.  In addition, a finding must be made that the petitioners constitute more than 50% of all the landowners and that the petitioners own more than 50% of the total area of the property, excluding certain public ownership.  The Town must also set a date, time and place for an Eligibility Hearing.  Separate public notices will be sent for the Eligibility Hearing. 

A finding of Substantial Compliance by Town Council does not annex the property to the Town; the finding affirms the petition requesting annexation is accurate and complete. 


General public hearing information

The Substantial Compliance public hearing will be held before Town Council on Tuesday, December 19, at 6 pm.  The agenda can be accessed by clicking https://crgov.com/2841/Council-Agendas. The agenda will be posted no later than the close of business on the Friday prior to the hearing date. When it is time for this item to be heard at the public hearing, staff will give a presentation on the proposed project. Following the presentation there will be an opportunity for questions and answers once the public comment period has been opened by the Mayor. All participants who wish to speak will be given the opportunity to do so.
